2. Pricing and Payment Terms

  • Monthly Subscription: Our Services are offered on a monthly subscription basis. Subscription fees are billed monthly in advance and are non-refundable unless otherwise specified.
     

  • Payment Method: Payments for our Services are processed securely through Stripe. You are required to provide valid payment details to process your subscription payment.
     

  • Default Payments: By subscribing to our Services, you authorize FutureConcept to charge your chosen payment method (via Stripe) automatically on a recurring monthly basis. If a payment fails (e.g., due to insufficient funds or expired credit cards), you will be notified, and you will have 7 days to update your payment details. If the payment is not successfully processed within this period, your access to Services may be suspended or terminated until payment is made.
     

  • Late Payments: If payment is not received on time, we reserve the right to suspend or terminate access to Services until the outstanding payment is made.
     

  • Price Changes: FutureConcept may update pricing at its discretion. Any price changes will be communicated to you via email, and such changes will take effect at the beginning of your next billing cycle.
     

3. Account Creation and Responsibilities

  • Account Registration: In order to use our Services, you may be required to create an account on our Website by providing accurate and up-to-date information.
     

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account.
     

  • Access to Your Social Media Accounts: To provide the Services, you may need to provide access to your social media accounts (e.g., Facebook, Instagram, Twitter). You authorize FutureConcept to manage your social media accounts in accordance with the agreed-upon Services.
     

4. Client Obligations
 

  • Content Approvals: You are responsible for providing all necessary content and approvals in a timely manner to enable us to execute the Services effectively. Upon your approval of content, you acknowledge and agree that it is your responsibility to ensure that all content complies with applicable Australian laws, including but not limited to intellectual property laws, advertising standards, and privacy regulations.
     

  • Legal Compliance and Ownership of Consequences: You agree that you will bear full responsibility for any legal or brand consequences arising from the content that you approve. This includes, but is not limited to, any issues relating to copyright infringement, defamation, misleading or deceptive conduct, or violation of third-party rights. FutureConcept will not be held liable for any legal or reputational issues that may arise as a result of content that you have approved for publication.
     

  • Prohibited Content: You agree not to use our Services to post or distribute any content that is illegal, offensive, defamatory, or violates the rights of third parties.
     

5. Intellectual Property
 

  • Ownership of Content: Any content created by FutureConcept as part of the Services (e.g., graphics, copywriting, social media posts) will be owned by you once payment has been made in full. However, FutureConcept may retain the right to use certain materials for promotional or marketing purposes unless otherwise agreed in writing.
     

  • Client's Materials: You retain ownership of all materials provided to FutureConcept (e.g., logos, photos, videos). You grant FutureConcept a non-exclusive license to use these materials solely for the purpose of performing the Services.
     

6. Confidentiality
 

FutureConcept agrees to maintain the confidentiality of any proprietary or confidential information that you share with us. However, we may disclose information as required by law or court order.
 

7. Termination
 

  • Termination by You: You may cancel your subscription at any time by providing us with written notice. Cancellations will take effect at the end of your current billing cycle.
     

  • Termination by Us: We may suspend or terminate your access to Services at any time if you breach these Terms, fail to make payment, or for any other reason we deem appropriate.
     

  • Effect of Termination: Upon termination, any outstanding fees owed will become immediately due and payable. Any data or content hosted by us may be deleted upon termination, subject to applicable retention laws.
     

8. Limitation of Liability
 

To the fullest extent permitted by law, FutureConcept will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, data, or business interruption, arising out of or in connection with the use of our Services.

Our total liability to you for any claims related to our Services will not exceed the total amount paid by you for the Services in the 12 months preceding the event giving rise to the claim.
 

9. Indemnity
 

You agree to indemnify and hold harmless FutureConcept, its employees, contractors, agents, and affiliates from and against any and all claims, losses, liabilities, and expenses (including legal fees) arising from your use of our Services, your breach of these Terms, or any violation of applicable laws, including any legal action resulting from content that you approve or provide.
 

10. Governing Law
 

These Terms are governed by and construed in accordance with the laws of the state of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia, Australia.
 

11. Amendments
 

FutureConcept reserves the right to modify or update these Terms at any time. We will notify you of any significant changes by email or by posting a notice on our Website. Continued use of our Services after changes to these Terms constitutes your acceptance of the revised Terms.
